The following are the terms of the privacy policy of Owners regarding use of The Site and The Software.

* Kinds of Information. Owners collect certain information in various ways from The Site and The Software and use that information in various ways. Among information that Owners may collect are real names, real addresses including the city, state and zip code in which you reside, email addresses, telephone numbers, social security numbers, information about your Internet connection or other information. Owners may also collect statistics about members, traffic patterns and related information as well as information gathered from the use of "cookie" or other technologies, whether from advertisements on The Site and The Software or otherwise, and all other such information. Owners may use and provide to others all such information but such information provided to others will not intentionally include such credit card information or account numbers except for the limited purposes of collecting payments, communicating with credit card companies and the like and in the event of any transaction related to any aspect of the business of Owners or other parties including but not limited to sales, mergers, acquisitions, bankruptcies and the like but Owners will not be liable for any inadvertent disclosure by Owners or any other parties. All such information may be used by Owners or other parties in the aggregate or individually and may be combined with other information and may be used in connection with marketing of such information or as part of a transaction related to any aspect of the business of Owners or other parties including but not limited to sales, mergers, acquisitions, bankruptcies and the like. You agree that Owners may use and provide to other parties all the said information and Owners and other parties may use all the said information that you provide, except as indicated. If you do not agree with the provisions of this paragraph, you should not provide any information to Owners.

* Affiliates, Advertisers and Other Links: Through Owners and The Site and The Software you may be introduced to a variety of other party vendors and sites including but not limited to vendors of goods and services, providers of other information and other such parties. Any links to such other vendors and sites are provided solely as a convenience and the above Agreement and Terms of Use shall govern all such links. The privacy polices and terms and conditions of service of these other parties are not under Owners' control and may differ from Owners' privacy policy and terms and conditions of service and you should read the privacy policies and terms and conditions of service of those vendors carefully. The use of any information that you may provide to any other party, or the use of "cookie" technology by any other party, will be governed by the privacy policy and terms and conditions of service of the operator of the other site that you are visiting. In some cases these other parties may share the information that they collect about you with Owners. If you have any doubts about the privacy or security of the information you are providing on another site or about their privacy policy and terms and conditions of service, Owners recommend that you contact that site directly for more information and review their privacy policy and terms and conditions of service. Owners are not now and never will be responsible for the actions of such other parties in any manner whatsoever, including but not limited to any violation of such privacy policies, terms and conditions of service or otherwise.

* Your Rights to Opt Out and Change or Delete Your Information: If you do not wish to receive e-mail or other correspondence related to Owners' or other parties' marketing, promotions, products or services, you should indicate your said preference when you sign up for The Site and The Software. You may change the information you provide by accessing your account or by sending Owners email at the address indicated below.

* Owners' Rights To Change. Owners may change this privacy policy or any aspect of it by publicly posting such changes on The Site but without any individual notice to you and if you use The Site after such change is so posted, you will be deemed to have accepted such change and such change shall be retroactively made a part of this privacy policy. Notwithstanding anything else in this privacy policy, Owners may release information when Owners believes that such release is reasonably necessary to (1) comply with law, (2) enforce or apply terms of any of agreement between you and Owners including but not limited to this agreement, or (3) protect the rights, property or safety of Owners, other users, or others.

* General Provisions. Please keep in mind that whenever you voluntarily disclose personal information online including but not limited to on The Site and The Software (for example on message boards, forums, through email, or in chat areas), that information is publicly available and is not private can be collected and used by Owners and by other parties and may result in unsolicited messages or other communications with you. Owners do not guarantee the security of any information you post.

If you have any complaints about The Site and/or The Software, you can contact Owners at the above email or other address. If you believe your copyright rights have been violated, you should notify Owners' Designated Agent. Residents of the state of California can obtain additional information about their rights from the Complaint Assistance Unit of the Division of Consumer Services of the Department of Consumer Affairs may be contacted in writing at 1020 N. Street, #501, Sacramento, CA 95814 or by telephone at (916) 445-1254. This agreement shall be subject to and interpreted under the laws of the state of Virginia applicable to agreements wholly to be performed therein as well as the laws of the United States, where applicable. Captions are for clarity sake only and have no substantive effect. This agreement is the complete understanding between you and Owners except that Owners may change the provisions of this agreement by posting such changes on The Site but without any individual notice to you and if you use The Site after such change is so posted, you will be deemed to have accepted such change and such change shall be retroactively made a part of this agreement. It shall bind and benefit each of your and Owners' respective heirs, assigns and successors in interest but any restrictions on assignment and transfer otherwise contained in this agreement shall otherwise apply. A waiver of any provision of this agreement, or any claimed breach thereof, shall not be deemed a waiver of any other provision or breach. All remedies provided Owners in this agreement are cumulative and the exercise by Owners of any remedy shall be without prejudice to Owners' exercise of any other rights or remedies available to Owners. Any dispute arising under this agreement shall be determined only by a court of competent jurisdiction only in Arlington, Virginia and Owners shall be entitled to injunctive relief. You expressly consent to personal jurisdiction in such state and in such court. In any action under this agreement, the prevailing party shall be entitled to attorneys' fees and court costs. In the event any portion of this agreement shall be held invalid or unenforceable it shall not affect the validity or enforceability of the rest of this agreement. All of the provisions of this agreement shall survive the termination of this agreement for any reason.

* Effective Date: The effective date for this privacy policy is August 1, 2008 and was last updated on August 1, 2008. IF YOU DO NOT AGREE WITH AND ACCEPT ALL OF THE FOREGOING PROVISIONS, DO NOT SIGN UP FOR THE SITE OR THE Software.
